Acceptance of Terms

Sitekick ("we," "us," or "our") provides website design, development, and related digital services (the "Services") through this website. By accessing this website or engaging us for a project, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, please do not use our Services.

We may update these Terms at any time. Continued use of our website or Services after a change is posted means you accept the updated Terms — check back periodically.

Our Services

We offer Express Websites (fixed-scope, fixed-price website builds), a DIY website builder, ongoing website care through our monthly subscription plan, and SEO services. Current packages and pricing are listed on our Express Websites, DIY Websites, and Monthly Subscription pages, and may change from time to time.

For our monthly subscription plan, we host and maintain your website on our infrastructure for as long as the subscription is active. We do not provide you with direct server, root, or hosting-account access — hosting and maintenance are handled by us as part of the plan. If your subscription ends, we will work with you on a reasonable transition (e.g. exporting your site or pointing your domain elsewhere) rather than simply taking the site offline without notice.

Payment, Cancellation & Refunds

Project work begins once we've confirmed scope with you and received payment or an agreed deposit. Because our website and design work is custom and time is committed to your project as soon as it starts, all completed project fees are final sale — we do not offer refunds once work has begun.

Cancelling before work begins

If you cancel before we've started work, any deposit paid is non-refundable, though at our discretion we may refund a deposit minus costs already incurred.

Cancelling after work begins

If you cancel after work has started, you're responsible for the cost of work completed to that point plus any expenses already incurred. If a project is substantially complete, the full project fee applies.

Monthly subscription

Our monthly Care Plan subscription bills in advance each month and can be cancelled at any time effective at the end of the current billing period — we don't offer partial-month refunds.

We understand plans change. If something comes up, contact us — we're glad to talk through options before you cancel.

Intellectual Property

Once a project is paid in full, you own the final website design and content we deliver for your project (excluding any third-party assets, stock imagery, fonts, or licensed software, which remain governed by their own license terms). We retain the right to display completed work in our portfolio and marketing materials unless you ask us not to.

This website's own content, design, and the Sitekick name and logo are the property of Sitekick and may not be copied or reused without our written permission.

Acceptable Use

When using our website or Services, you agree not to:

  • Use our Services for any unlawful purpose or to violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Interfere with or disrupt the operation of our website, Services, or servers
  • Attempt to gain unauthorized access to any account, system, or data
  • Provide false or misleading information when engaging our Services

We reserve the right to suspend or terminate Services if we reasonably believe they're being used unlawfully or in violation of these Terms.

Disclaimer of Warranties

Our website and Services are provided "as is" and "as available." We don't guarantee specific business outcomes, search rankings, traffic, or conversions from any website or SEO work — results depend on many factors outside our control. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, and we don't guarantee our website or Services will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages arising from your use of our website or Services. Our total liability for any claim relating to our Services will not exceed the amount you paid us for the Services giving rise to the claim in the 12 months prior.

Indemnification

You agree to indemnify and hold Sitekick and its team harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms, misuse of our Services, or content you provide us to publish on your website.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles, and any disputes will be resolved in the state or federal courts located in New Jersey.
